Conditions of Sale
1. The auction is held voluntarily in the name and for the account of third parties on the basis of consignment contracts. As an auction, the sales are expressly not subject to the provisions of the Distance Selling Act (FAG), in particular with regard to the right of return.
2. The auction is conducted in euros and against immediate payment. Bidding is in fixed increments:
1 to 19 €: 1 €
20 to 49 €: 2 €
50 to 99 €: 5 €
100 to 199 €: 10 €
200 to 499 €: 20 €
500 to 999 €: 50 €
from 1.000 €: 100 €
3. The auctioneer has the right, at his sole discretion, to demand security in the form of a deposit payment to be determined by him from bidders unknown to him or from bidders whose bids significantly exceed the empirical values of an existing business relationship. The auctioneer also has the right not to consider bids, if a deposit payment requested by him has not been received by the start of the auction.
4. The call is made at the price stated in the auction catalog. The submission of a bid constitutes a binding offer to purchase. The bidder remains bound by his bid until it is either expressly outbid or rejected by the auctioneer.
5. The highest bidder is automatically awarded the item by the Invaluable System and is obliged to accept and pay for it. The bidder is personally liable for his bid, even if he bids on behalf of third parties and submits their names.
6. The auctioneer has the right to withdraw lots, to accept the bid subject to reservation or to reject it.
7. A premium of 19% and a live fee of 5% shall be paid on the hammer price. Statutory VAT (currently 19%) will be charged on the buyer's premium, the live fee and the shipping costs (Germany 8.50 € or outside Germany 15.00 €).
8. Ownership is only transferred to the buyer after full payment of the purchase price, but the risk of any damage is already transferred with the acceptance of the bid. Payment of the purchase price must be made by credit card (4% surcharge on the total amount to be paid, VISA or MasterCard only) or by bank transfer to the auctioneer within 10 days of receipt of the invoice.
9. In the event of late receipt of payment or default of acceptance, the successful bidder shall be liable for all damages incurred, in particular for currency and interest losses. In the event of default, the auctioneer may demand either fulfillment of the purchase contract or compensation for non-fulfillment. The auctioneer may also cancel the knockdown and put the item up for auction again at the buyer's expense. If the auctioneer exercises this right, the successful bidder shall be liable for any loss, but shall not be entitled to any additional proceeds.
10. The items to be auctioned may be inspected and examined prior to the auction at the times indicated. The catalog descriptions are made carefully, but the catalog details are not warranted characteristics according to § 459 BGB. The items to be auctioned are used and in appropriate condition.
11. Justified complaints must be made no later than three days after receipt of the auctioned items, but no later than two weeks after the end of the auction.
12. The shipment of the auctioned items shall be at the expense and risk of the purchaser. The consignment shall only be insured upon written instruction. The sender shall be deemed to have done everything necessary for shipment upon posting.
13. By placing a bid, the successful bidder expressly recognizes the conditions.
14. Upon written request, stating a justified reason, the name and address of the consignor may be notified to the successful bidder immediately after the auction against reimbursement of costs, and the name and address of the successful bidder to the consignor.
15. All documents are stored in an image database at the auctioneer. It is therefore possible that archive material (i.e. an item with a different item number) may be used for illustrations. The buyer has no claim to the item depicted. The buyer's claim relates to the item described in the lot with the item number described herein.
16. Place of fulfillment and jurisdiction for both parties is Wolfenbuettel, as far as legally permissible.
17. Should parts of these auction conditions be ineffective, the remaining parts shall nevertheless remain effective.
Payment
