Conditions of Sale
TERMS & CONDITIONS
The buyer is requested to pay for and collect the purchased works within five work days after the date of purchase.
You can pay in cash up to € 3000, with bancontact or wire transfer.
In case of non-payment within the term, 20% interest will be charged.
The buyer pays the sales costs and resale rights, if the latter applies.
The sales costs for the buyer are 22% of the hammer price in the modern art auction, and for the other auctions this is 25%. When bidding via online platforms, an additional 3% is added.
The resale right is charged up to and including 70 years after the year of the artist's death,
for lots with a hammer price of € 2,000.00 or more. The amount of the resale right is determined as follows:
• 4% on the part of the sales price up to and including € 50,000.00;
• 3% on the part of the sales price from €50,000.01 to €200,000.00;
• 1% on the part of the sales price from € 200,000.01 to € 350,000.00;
• 0.5% on the part of the sales price from € 350,000.01 to € 500,000.00;
• 0.25% on the part of the sales price above € 500,000.00.
The maximum amount of the resale right is € 12,500.00.
Once the adjudication has been made, no complaint of any kind will be accepted, even if it relates to the description in the catalogue.
In the event of non-payment of an adjucated lot, it will be auctioned again, either immediately or at a subsequent auction, but this time
at the expense of the first buyer, who will be obliged to pay any difference, without being able to receive the surplus, if there is one..
On the 5th work day following the auction, additional handling and storage costs are fully borne by the buyer.
Every buyer is expected to act on his own behalf and is personally responsible for the orders he carries out when he would purchase in the capacity of agent.
In the event of a dispute, only the courts of Antwerp have jurisdiction.
No payment is accepted during the sale.
The board of n.v. Campo Guillaume accepts the bids entrusted to it.
During our auctions, the lots actually sold and withheld are recorded on the registration sheet (official report) of the bailiff.

CONDITIONS DE LA VENTE
La vente se fera strictement au comptant.
En cas de non-paiement au comptant, un intérêt de 20% sera appliqué.
Les acquéreurs paieront 25% en plus de leurs prix d'achat pour frais de vente. En plus, s'il y a lieu, le droit de suite sur les œuvres qu'il frappe.
Ils seront tenus de faire enlever les tableaux ou autres objets acquis le lendemain de la vente avant midi et ce à leurs frais.
Une fois l'adjudication prononcée il ne sera admis aucune réclamation, de quelque nature qu'elle soit, même si elle a pour objet la description dans le catalogue.
En cas de non-paiement d'un effet adjugé, celui-ci sera revendu soit sur-le-champ, soit lors d'une des ventes suivantes, à la folle enchère de l'adjudicataire, qui sera tenu de payer la différence éventuelle, sans cependant pouvoir réclamer l'excédent s'il y en a.
Tout acheteur sera réputé avoir agi pour son propre compte et tenu personellement responsable des commissions qu'il exécutera ou dès lors qu'il achèterait en qualité de mandataire.
En cas de litige ou de contestation, seuls les Tribunaux d'Anvers seront compétents.
On n'accepte pas de paiement pendant la vente.

MODIFICATION DU DROIT DE SUITE
La législation sur le droit de suite entre en vigueur à partir du 1 novembre 2007,
- le seuil: sera augmenté vers un prix d'achat de 2.000,00 EUR à chaque transaction entre acteurs professionnels du marché de l'art agissant en tant qu'acheteur, vendeur ou intermédiaire, le droit de suite est dû quand le prix est au-delà de 2.000,00 EUR et que le délai de 70 ans après le décès de l'artiste n'est pas dépassé
- tarifs: seront désormais dégressifs selon la directive européenne: le montant du droit de suite est calculé ainsi:
- 4% de la partie du prix de vente jusque 50.000,00 y compris;
- 3% de la partie du prix de vente de 50.000,01 EUR à 200.000,00 EUR y compris;
- 1% de la partie du prix de vente de 200.000,01 EUR à 350.000,00 EUR y compris;
- 0,5% de la partie du prix de vente de 350.000,01 EUR à 500.000,00 EUR y compris;
- 0,25% de la partie du prix de vente au-delà de 500.000,00 EUR
Le montant maximum du droit est plafonné à 12.500,00 EUR.

VERKOOPSVOORWAARDEN
De verkoop geschiedt uitsluitend kontant.
Bij niet-kontante betaling wordt 20% intrest aangerekend.
De kopers betalen, buiten hun aankoopprijs, 25% voor verkoopsonkosten. Bovendien desgevallend een volgrecht op de getroffen werken.
Zij zijn gehouden de schilderijen of andere voorwerpen door hen verworven, te doen weghalen de dag na de verkoop, vóór de middag, en op hun kosten.
Eenmaal de toewijzing uitgesproken zal geen enkele klacht worden aanvaard, van welke aard ook, zelfs niet indien zij slaat op de beschrijving in de katalogus.
Bij niet-betaling van een toegewezen lot, wordt dit opnieuw opgeroepen, hetzij dadelijk, hetzij op een der volgende veilingen, doch ditmaal ten laste van de rouwkoper, welke zal gehouden zijn het eventueel verschil bij te betalen, zonder nochtans het overschot te kunnen vorderen, indien er een is.
Iedere koper is geacht voor eigen rekening te handelen en is persoonlijk verantwoordelijk voor de opdrachten die hij uitvoert of wanneer hij zou aankopen in hoedanigheid van lasthebber.
In geval van betwisting zijn alleen de Rechtbanken van Antwerpen bevoegd.
Men aanvaardt geen betaling tijdens de verkoop.
Het bestuur van N.V. CAMPO Guillaume., Grote Steenweg 19-21, 2600 Antwerpen -- Tel. +32 (3) 218 47 77 aanvaardt de orders haar toevertouwd.
VOLGRECHT
Vanaf 1 november 2007 is de nieuwe wetgeving aangaande het volgrecht van kracht
- drempel: deze wordt verhoogd naar een verkoopprijs van 2.000 EUR. Dit wil dus zeggen dat bij doorverkopen waarbij actoren uit de professionele kunsthandel (zoals veilingzalen) optreden als koper, verkoper of tussen persoon een volgrecht zal verschuldigd zijn wanneer de doorverkoopprijs 2.000 EUR of meer is, en de beschermingsduur nog niet verstreken is (tot 70 jaar na het overlijden van de kunstenaar)
- tarieven: deze worden ook gewijzigd in een degressief tarief in schijven. Het bedrag van het volgrecht wordt bepaald als volgt :
- 4 % van het deel van de verkoopprijs tot en met 50.000 EUR;
- 3 % van het deel van de verkoopprijs van 50.000,01 EUR tot en met 200.000EUR;
- 1 % van het deel van de verkoopprijs van 200.000,01 EUR tot en met 350.000 EUR;
- 0,5 % van het deel van de verkoopprijs van 350.000,01 EUR tot en met 500.000 EUR;
- 0,25 % van het deel van de verkoopprijs boven 500.000 EUR.
Het maximumbedrag van het recht mag evenwel niet hoger liggen dan 12.500 EUR. (zie art5 van de wet van 4 december 2006, dat met vanaf 1 november 2007 artikel 12 van de auteurswet vervangt).

We will send you a selection of carriers together with your invoice after the auction
If the concerned items are small and of lesser value, we might make an exception to send these by post, but Campo & Campo is not liable nor responsible for any damage, loss or other problems
If lots are not collected in due time, a handling fee of 50 Euro will be charged and storage costs of 2 Euro per lot per day
