TERMINI E CONDIZIONI GENERALI DEL CONTRATTO
1.Termini di utilizzo
Il presente contratto prevede i Termini di utilizzo del sito internet denominato , www.uncartauctions.com e giuridicamente vincolante tra le parti, Unicart Srl e il fruitore. Tali Termini di utilizzo regolano l'accesso e l'utilizzo del sito web, incluse eventuali pagine e domini interni al sito web.
In caso di discrepanza tra le versioni in lingue diverse dei presenti Termini di utilizzo, prevarrà la versione in lingua italiana.
2.Le altre informative applicabili
Le vendite e/o l'acquisto di Lotti sul Sito internet, saranno condizionate alla preventiva registrazione e all'accettazione delle condizioni contrattuali.
3.Termini e condizioni per Venditori
Per l'offerta dei Lotti all'asta sul Sito internet, saranno applicate le regole specifiche per i Venditori, che si potranno consultare cliccando "come vendere" che dovranno essere preventivamente accettate
4.Termini e condizioni per Acquirenti
Per acquistare dei beni e/o dei Lotti all'asta sul Sito internet, si applicano regole specifiche nell'apposita area che si potranno consultare cliccando "come acquistare" che dovranno essere preventivamente accettate
5.Privacy
In virtù della normativa vigente sulla Privacy, il fruitore potrà consultare l'Informativa sulla Privacy. Utilizzando il Sito online, acconsentendo all'utilizzo delle informazioni ai fini stabiliti dalla Informativa sulla Privacy (D.L. 196/2003 e successive modifiche e D. L. 101/2018).
Per consentire all'utilizzatore -venditore/acquirente di poter adempiere agli obblighi derivanti da un Contratto di Vendita (asta on-line), saranno messe a disposizione dei venditore/acquirente che lo richiedono le necessarie informazioni personali necessari ed utili al fine della conclusione del contratto (a solo titolo esemplificativo verranno messe e disposizione nome, indirizzo e-mail, numero di telefono e indirizzo) di altri Utenti. Tali informazioni saranno fornite al fine di garantire al Venditore le informazioni necessarie per poter spedire il bene aggiudicato all'Acquirente. La Unicart Srl non potrà essere ritenuta responsabile della correttezza dei dati personali forniti dall'utilizzatore al momento della registrazione e successivamente, condiviso con un altro Fruitore. L' Unicart S.r.l. e l'Utente che riceve i dati personali sono considerati titolari separati e indipendenti del trattamento dei dati personali ai sensi delle leggi e dei regolamenti applicabili in materia di protezione dei dati personali. Nel caso in cui Unicart Srl e un Utente risultino congiuntamente responsabili del trattamento dei dati personali rilevanti, e nel caso in cui la Unicart Srl venga citato in giudizio, multato o subisca in altro modo danni per qualsiasi carenza che possa essere attribuita all'Utente in questione, l'Utente accetta di risarcire Unicart Srl per tali danni.
L'utente (venditore e/o acquirente) riceverà i dati personali di un altro fruitore, che dovranno essere trattati in conformità con le leggi e i regolamenti (sulla protezione dei dati) applicabili. I fruitori dovranno trattare le informazioni solo per adempiere ai propri obblighi, al fine di risolvere eventuali problemi derivanti dal Contratto di Vendita e/o per adempiere a determinati obblighi di legge. I dati forniti non potranno essere utilizzati per nessuna ragione a fini commerciali. In caso di violazione delle disposizioni di questo Articolo, risulteranno responsabile per i danni subiti dalla società in oggetto.
6.Ambito del Servizio
Viene messe a disposizione dei fruitori dei servizi il Sito online dove è possibile fare offerte, acquistare e vendere oggetti d'arte (cd "Lotti") attraverso le aste online automatizzate ("Aste online"). Vengono considerati "fruitore" tutti coloro che utilizzano il Sito online mediante apposita registrazione. Gli Utenti che acquistano Lotti mediate l'utilizzo del sito sono denominati "Acquirenti" ed il fruitore che vendono Lotti sono denominati "Venditori". L'ambito del Servizio è il seguente:
A) I Venditori sono responsabili per i Lotti che vendono.Unicart Srl non eserciterà nessun controllo è pertanto non potrà essere considerato responsabile della qualità, sicurezza, legittimità o esattezza dei Lotti. Unicart Srl svolge un ruolo puramente ausiliare, mettendo a disposizione il solo Sito online.
B) La Unicart Srl non è parte nel Contratto di Vendita. Gli Acquirenti stipuleranno automaticamente un accordo di acquisto ("Contratto di Vendita") dopo che l'acquirente raggiunge il prezzo di riserva, quindi si aggiudica il lotto, con il Venditore di uno specifico Lotto per l'importo dell'Offerta più alta (il "Prezzo di acquisto"). Non vi sarà alcun Contratto di Vendita solo nel caso in cui il Venditore abbia fissato un prezzo minimo ("Prezzo di riserva") e il prezzo di riserva non venga raggiunto.
Gli obblighi e i diritti derivanti dal Contratto di Vendita sono riportati nell'apposita area Termini e condizioni "come acquistare" per Acquirenti e/o Termini e condizioni per Venditori "come vendere".
7.Commissione per l'utilizzo del Sito e del servizio offerto.
La Unicart Srl, in virtù del servizio offerto per l'utilizzo del sito nell'operazioni di vendita avrà diritto ad una commissione:
A) commissione a carico degli acquirenti pari al 19 % del prezzo di acquisto iva inclusa, che verrà sommato al prezzo di acquisto.
B) Una commissione a carico del venditore pari al 12 % del prezzo di acquisto iva inclusa che verrà scomputato dal pagamento del Prezzo di acquisto. La Commissione a carico del Venditore sarà aumentata dell'IVA, ed eventuali tasse (ritenute alla fonte), imposte e dazi se applicabili. Per i soggetti professionali, aventi partita iva, operanti nel settore delle aste di oggetti di valore, mettendo in vendita sulle nostre piattaforme un minimo di 10 pezzi, la commissione a carico del venditore può arrivare fino ad un minimo del 3%. In questo caso è necessario contattare il nostro reparto commerciale e stipulare un ulteriore accordo parallelo.
8. La registrazione
Prima di poter utilizzare il Servizio offerto dal sito www.unicartauctions.com, è necessario creare un Account.
Al momento della registrazione ed alla creazione dell'Account dovranno essere fornite le seguenti informazioni:
- Tutti i fruitori sono tenuti a fornire informazioni complete e veritiere sulla persona fisica e/o o sull'azienda sarà comunque, necessario fornire copia dei documenti d'identità, da inviare al seguente indirizzo e-mail [email protected] L'utilizzo dei dati di accesso è consentito alla persona o azienda iscritta. Le informazioni fornite dovranno sempre essere aggiornate.
- Il fruitore dovrà indicare un proprio "nickname" durante la registrazione che verrà reso pubblico per ogni offerta effettuata durante l'asta.
- Al fruitore, successivamente alla registrazione, sarà associato un "codice ID" in caso di messa all'asta di almeno un lotto, il "codice ID" del venditore sarà pubblicato nelle specifiche/descrizione del lotto in oggetto.
- Il fruitore è l'unico responsabile, per qualsiasi attività relativa al proprio Account. Unicart Srl non avrà la possibilità di verificare chi è il reale utilizzatore del proprio Account e pertanto, non avrà alcuna responsabilità in merito all'utilizzo.
9.Termini di utilizzo e limitazione dell'Account
Al fine di garantire l'affidabilità del sito la Unicart S.r.l., si riserva il diritto di limitare l'uso e/o l'accesso all'Account in caso di utilizzo che violino le condizioni contrattuali e/o la legge. É vietato registrarsi, accedere e/o utilizzare il Sito online tramite l'Account di un altro Utente.
10. Regole dell'Asta
Al fine di garantire il buon andamento delle Aste online di seguito le regole di partecipazione:
istruzioni vincolanti. Si è tenuti a rispettare tutte le eventuali indicazioni e istruzioni valide relativamente alle Aste online, che vengono fornite da Unicart S.r.l.
Ogni Offerta è vincolante.qualsiasi Offerta proveniente dal proprio Account sarà considerata effettuata dall'utente registrato. Anche se l'Offerta viene fatta da terzi mediante l'utilizzo dell'Account.
È vietato fare offerte per i propri Lotti o per i Lotti di persone allo stesso collegate. Non è consentito che una persona collegata al venditore faccia offerte sui lotti di quest'ultimo. Tale procedura viene denominata "offerta con rialzo a trabocchetto", ed è contraria alle condizioni di utilizzo del sito.
È vietato contattare direttamente gli utilizzatori e/o terze parti per concludere un contratto di acquisto al di fuori del sito per Lotti messi in vendita sullo stesso.
Unicart Srl, ha il diritto di impedire temporaneamente o permanentemente in qualsiasi momento (prima, durante e dopo un'Asta online) le offerte sui Lotti.
Unicart Srl, a sua discrezione, ha il diritto di rimuovere un'Offerta in un'Asta online in corso se lo ritiene necessario (ad esempio in caso di possibile abuso o frode e in caso di ovvio errore da parte dell'offerente). In caso di eliminazione di un Lotto, anche tutte le offerte verranno rimosse
11. Diritto di recesso
I Consumatori hanno diritto a una garanzia legale sulla conformità dei Lotti previsto dalla direttiva UE sui diritti dei consumatori (2011/83/UE).
È possibile che l'applicazione del diritto di recesso europeo sia valida per il proprio Contratto di acquisto. I consumatori che risiedono in un paese all'interno dello Spazio Economico Europeo e acquistano un Lotto da un Venditore professionista hanno diritto a recedere dall'acquisto entro un periodo di 14 giorni ("tempo di ripensamento"), senza bisogno di giustificazione.
In caso di recesso, l'utente dovrà restituire il Lotto entro 14 giorni dalla notifica di recesso. il Lotto dovrà essere restituito al Venditore con tutti gli accessori consegnati nello stato e nell'imballaggio originale. L'acquirente sarà responsabile soltanto per ogni eventuale diminuzione del valore del Lotto derivante da una gestione che vada oltre quanto necessario per stabilire la natura, le caratteristiche e il funzionamento del Lotto stesso. L'utente avrà diritto al rimborso dell'intero Prezzo di acquisto, incluse spese di spedizione, e la Commissione a carico dell'Acquirente. Tuttavia, ogni costo diretto per la restituzione del Lotto sarà a carico dell'acquirente.

12.Regole per Utilizzo del Sito online
La Unicart Srl è autorizzata, a limitare il servizio relativo alla vendita e/o l'offerta sul sito on-line, qualora uno degli utenti risieda in uno dei paesi con restrizione alla fornitura ai servizi di pagamento. Qualora sia stato già creato un Account l'utente verrà informato e verrà limitato il Servizio relativo all'Account in questione.
Facendo uso del Sito online, l'utilizzatore è tenuto ad attenersi a tutta la normativa nazionale, europea e internazionale applicabile per quanto riguarda l'esercizio dell'offerta, inserimento di oggetti nelle aste, acquisto e vendita di Lotti tramite il Sito online.
L'utilizzatore acconsente a non compiere atti che possano comportare un carico irragionevole e/o sproporzionato all'infrastruttura del Sito online e/o che possano ostacolare la funzionalità del Sito stesso.
13. Materiale dell'Utente
Durante l'uso del Sito online www.unicartauctions.com, è necessario caricare materiale come ad esempio descrizioni di Lotti, fotografie, specifiche, opinioni, messaggi, offerte di vendita e/o annunci (cfr. Come vendere) Le seguenti regole si applicano a qualsiasi Materiale dell'Utente caricato.
L'utente comprende e accetta di essere responsabile per il Materiale dell'Utente che viene pubblicato sul Sito online. Comprende e accetta che il Materiale dell'Utente caricato e/o pubblicato sul Sito online: non è ingannevole, inappropriato o falso e non promuove attività illegali.
Non pregiudica in alcun modo la buona reputazione di Unicart Srl, delle imprese ad essa collegate e/o dei suoi amministratori.
È libero da oneri, non comporta violazione di leggi o regolamenti o dei presenti Termini di utilizzo, non viola diritti di terzi e non costituisce in nessun altro modo illecito nei confronti di terzi o di Unicart Srl.
Pubblicando il Materiale dell'Utente sul Sito online, concedi a Unicart Srl una licenza d'uso. Il venditore mantiene comunque tutti i diritti di proprietà intellettuale sul Materiale dell'Utente stesso. Tuttavia, conferisci a Unicart Srl una licenza gratuita, esente da diritti parziali, estesa a tutto il mondo, non esclusiva, perpetua e non revocabile che consente di rendere di pubblico dominio il Materiale dell'Utente e/o di riprodurlo per tutti gli scopi che Unicart Srl ritenga necessari (compresi scopi promozionali).
Tale licenza ci permette di promuovere i lotti dell'utente-venditore e di promuovere il Sito online in qualsiasi formato e attraverso qualsiasi canale. In base a tale licenza, Unicart Srl ha il diritto di tradurre il Materiale dell'Utente e promuoverlo sulla propria pagina principale o in altro materiale promozionale (inclusi social media), con lo scopo di promuovere l'attività di vendita e il Sito online. L'utilizzo del Materiale dell'Utente è utile al successo di Unicart Srl ed è pertanto vantaggioso per tutti gli Utenti. È anche per tale motivo che la licenza non termina nel caso in cui l'Account venga cancellato o nel momento in cui l'utente decida di interrompere l'utilizzo del Sito online. Pertanto, l'utente accetta di non rivendicare alcun diritto morale sull'utilizzo del Materiale dell'Utente nei confronti di Unicart Srl.
L'Unicart Srl ha il diritto di far tradurre il Materiale dell'Utente relativo ad un determinato Lotto utilizzando anche traduzioni con procedimento automatico. Unicart Srl può, discrezionalmente, interrompere il Contratto di vendita per conto di un Utente, che dimostri di essere stato influenzato negativamente e da un errore di traduzione. Il lotto può essere rimosso mentre quest'ultimo è ancora all'asta, nel caso in cui ci sia una traduzione non corretta del Lotto.
13.Segnalazione di contenuti illeciti o non autorizzati.
L'Unicart Srl, potrà rimuovere il Materiale dell'Utente di natura manifestamente illecita. Inoltre, si riserva il diritto di non accogliere una richiesta intesa a che si blocchi, o rimuova Materiale dell'Utente o si interrompa un'attività nel caso in cui abbia buoni motivi per dubitare dell'esattezza della comunicazione o della liceità delle prove fornite.
Se l'Unicart Srl lo ritiene opportuno, ha il diritto di rimuovere o modificare il Materiale dell'Utente dal Sito online, senza essere ritenuto responsabile di alcun danno e senza essere obbligato a pagare alcun risarcimento.
14. Risoluzione, sospensione e altre misure
Risoluzione
L'utente potrà rimuovere il proprio Account in qualunque momento. Unicart Srl ha il diritto di rifiutare la rimozione dell'Account nel caso in cui sia ancora necessario adempiere a determinate obbligazioni (quali obblighi di pagamento o consegna) nei confronti di Unicart Srl o di altri Utenti o nel caso in cui ci fosse la possibilità che insorgano ancora reclami correlati ai Lotti recentemente venduti. Potrà pertanto risolvere per i seguenti motivi:
a- Unicart Srl, ha il diritto di rimuovere l'Account nel caso in cui sia obbligata per legge a limitare il Servizio nei confronti dell'utente o nel caso in cui non sia più nel proprio interesse commerciale.
b- Unicart Srl nel caso di qualsiasi violazione dei presenti Termini di utilizzo può comportare l'immediata chiusura dell'Account dell'utenti senza che si rendano necessari requisiti formali (es. una notifica ingiuntiva dell'inadempienza).
Sospensione - Unicart potrà sospendere il Servizio.
- nel caso in cui abbia motivi sufficienti per ritenere che l'utente non stia agendo in conformità ai presenti Termini di utilizzo. Pertanto, Unicart Srl potrà sospendere l'utilizzo di tutti gli Account dall'utente utilizzati o gestiti secondo disposizioni.
Unicart Srl si riserva il diritto di avviare reclami.
In caso di reclamo - regolata dal diritto obbligatorio (dei consumatori), Unicart Srl ed in conformità a tale diritto - al fine garantire i propri diritti Unicart Srl e quelli di altri Utenti (ad esempio, in caso di violazione dei Termini di utilizzo), ci si riserva il diritto, in qualsiasi momento e discrezionalmente, di:
(1) sospendere il pagamento o il rimborso, (2) trattenere il pagamento, (3) compensare qualsiasi richiesta di risarcimento finanziario.
Unicart Srl si riserva il diritto di prendere ulteriori misure di protezione.In aggiunta a quanto sopra, Unicart Srl potrà adottare altre misure per proteggere il proprio Sito online ed i propri Utenti da comportamenti illeciti, fraudolenti o altrimenti inappropriati.
15. Manutenzione del Sito online
Unicart Srl ha in qualsiasi momento il diritto di apportare, senza preavviso, modifiche o migliorie procedurali, tecniche, commerciali o di altro tipo al Sito online. Ha inoltre il diritto di rendere (temporaneamente) non disponibile il Sito online e/o di limitarne l'uso qualora si ritenga necessario ed a discrezione di Unicart Srl (ad esempio ai fini di una manutenzione giustificata del Sito online).
16. Declino di responsabilità
L' Unicart Srl, nei limiti di quanto consentito dal diritto imperativo, declina qualsiasi responsabilità per danni conseguenti da:
da atti illeciti o di altre origini che sorgono dall'uso improprio del sito on-line
La conclusione, esecuzione (inclusa la consegna dei Lotti) e/o scioglimento di un Contratto di Vendita da parte di Acquirente o Venditore
L'annullamento di una transazione da parte di Unicart Srl o lo scioglimento di un Contratto di Vendita da parte di Unicart Srl per conto di un Utente
Eventuali errori nel testo che sono risultato di traduzioni con procedimento automatico
Materiale dell'Utente (come ad esempio fotografie e descrizioni dei Lotti)
Uso illecito del Sito online
l'utilizzo dei servizi dei Fornitori di servizi terzi
Problemi tecnici o altri errori del Sito online
17. Richiesta di risarcimento danni
L'utente è tenuto a segnalare per iscritto a Unicart Srl il danno entro e non oltre tre giorni dalla scoperta dello stesso. Ogni pretesa intesa al risarcimento di danni avanzata contro Unicart Srl decade al semplice scadere dei tre mesi (3) mesi dal momento in cui è sorto il danno per la prima volta.
Tale periodo di limitazione si applica anche qualora l'utente non abbia fornito le informazioni di contatto, personali e/o bancarie al fine dell'adempimento a seguito della richiesta fatta e che dovrà avvenire a pagarti o rimborsarti, ma l'utente non abbia inviato le necessarie informazioni all'adempimento, dopo la richiesta (almeno una volta) per posta o per telefono. In tali situazioni, il termine decorrerà dal momento in cui (i) la richiesta di risarcimento è divenuta esigibile o (ii) il Contratto di Vendita è stato sciolto dalla Unicart S.r.l. per conto di un Utente.
18. Articolo: Manleva
Nella misura massima consentita dalla legge applicabile, l'utente dichiara di manlevare l'Unicart Srl contro qualsiasi pretesa di altri Utenti o terze parti Unicart Srl. L'utente dichiara altresì, di mantenere indenne e manlevare l'Unicart Srl da qualsiasi danno arrecato e di tutte le spese sostenute dallo stesso in conseguenza di:
(i) mancata esecuzione dei Termini di utilizzo da parte tua, (ii) una tua condotta inappropriata durante l'uso del Sito online, (iii) una tua eventuale violazione di leggi o normative oppure (iv) atto illecito. Gli obblighi di manleva di cui nel presente Articolo valgono anche nei confronti di tutte le imprese collegate all'Unicart, nonché del suo organo amministrativo, dei suoi singoli amministratori, dipendenti, rappresentanti e aventi causa.
19. Controversie con altri Utenti
Utenti dovranno risolvere tra loro qualsiasi controversia insorta tra gli stessi. Ove necessario, Unicart Srl farà quanto ragionevolmente possibile per mediare tra il Venditore e l'Acquirente.
Eventuali reclami e controversie tra Venditore e Acquirente vanno portati il più presto possibile a conoscenza di Unicart Srl, impegnandosi a supportare gli utenti a risolvere la controversia in buona fede e in linea con i Termini di utilizzo.
Nel caso in cui la controversia non trovi risoluzione bonari, gli utenti acconsentono affinché Unicart Srl possa decidere definitivamente se rimborsare l'Acquirente o pagare il Venditore. La decisione si baserà su tutte le informazioni pertinenti disponibili, tenendo conto di eventuali accordi tra l'Acquirente e il Venditore. È importante chiarire che la decisione dell'Unicart S.r.l., non ha alcun effetto sulla validità del Contratto di Vendita. Indipendentemente dalla decisione presa, l'Acquirente e il Venditore sono liberi di ottenere i diritti derivanti dal Contratto di Vendita o di discutere tra loro le rivendicazioni relative al Contratto di Vendita. Tuttavia, non sorgerà per l'Unicart S.r.l. l'obbligazione di risarcire danni o versare indennizzi all'Acquirente o al Venditore qualora non siano d'accordo con la decisione.
Qualora gli Utenti decidano di sciogliere il Contratto di Vendita tra loro, gli Utenti perdono il diritto di ricevere il rimborso della relativa Commissione a carico dell'Acquirente e/o Commissione a carico del Venditore.
Tutti i Contratti di Vendita tra Venditori e Acquirenti sono regolati dalla legge Italiana. Le parti accettano e riconoscono, che è possibile che norme di diritto privato internazionale comportino l'applicazione di una legge diversa dalla legge Italiana nel caso di un Contratto di Vendita con altri Utenti.
20. Foro competente Controversie
I presenti Termini di utilizzo, l'uso del nostro Sito online ed eventuali controversie che ne derivano sono regolate dalla legge italiana, salvo diversa disposizione di diritto imperativo.
Tutte le controversie che sorgono tra l'Unicart S.r.l e l'utente sarà di competenza del foro di Roma
21. Modifica dei Termini di utilizzo
l'Unicart S.r.l può modificare o integrare in qualsiasi momento i presenti Termini di utilizzo pubblicandoli sul Sito online. Se una modifica o un'integrazione influisce in maniera notevole sui diritti delle parti o sulle obbligazioni, invierà una notifica tramite e-mail, o comunicherà le modifiche durante l'utilizzo del proprio sito.
Se successivamente alle modifiche e le o integrazione dei Termini di utilizzo, l'utente continuerà ad utilizzare il sito on-line dimostrerà con ciò di accettare irrevocabilmente i Termini di utilizzo nella nuova stesura modificata o integrata. Nel caso in cui l'utente non accetti i Termini di utilizzo modificati o integrati, potrà interrompere l'utilizzo del Sito online ed eliminare il proprio Account.
L'Unicart S.r.l. si riserva il diritto di trasferire a terzi i diritti e gli obblighi che derivano da questi Termini di utilizzo. Se l'utente non troverà accettabile il trasferimento di obblighi a terzi, potrai interrompere l'utilizzo del Sito online e cancellare l'Account, fatta salva l'applicazione dell'articolo relativo alla risoluzione e sospensione contrattuale.
22. Continuazione
Nel caso in cui una o più disposizioni di questi Termini di utilizzo siano nulle o non valide in tutto o in parte per qualsiasi motivo, l'Utente e l'Unicart S.r.l rimangono vincolati dai restanti Termini di utilizzo. l'Unicart S.r.l provvederà a sostituire la parte nulla e/o non valida (in relazione all'Utente specifico o alla situazione specifica) con disposizioni valide.
REGOLAMENTO PER L'ACQUIRENTE
Come Acquistare
Unicart Srl mette a disposizione un sito internet www.unicartauctions.com su cui è possibile acquistare e vendere oggetti d'arte. l'utente prima di utilizzare il nostro sito internet devono accettare e rispettare e le condizioni stabilite nei nostri Termini e condizioni d'uso.
1- Registrazione
Prima di poter utilizzare il Servizio offerto dal sito www.unicartauctions.com, è necessario creare un Account. Al momento della registrazione ed alla creazione dell'Account dovranno essere fornite le seguenti informazioni: - Tutti i fruitori sono tenuti a fornire informazioni complete e veritiere sulla persona fisica e/o o sull'azienda sarà comunque, necessario fornire copia dei documenti d'identità, da inviare al seguente indirizzo e-mail [email protected]. L'utilizzo dei dati di accesso è consentito alla persona o azienda iscritta. Le informazioni fornite dovranno sempre essere aggiornate Il fruitore dovrà indicare un proprio "nickname" durante la registrazione che verrà visualizzato quando verrà effettuata l'offerta - Il fruitore è l'unico responsabile, per qualsiasi attività relativa al proprio Account. Unicart Srl non avrà la possibilità di verificare chi è il reale utilizzatore del proprio Account e pertanto, non avrà alcuna responsabilità in merito all'utilizzo. Regolamento asta
Ogni Offerta è vincolante.qualsiasi Offerta proveniente dal proprio Account sarà considerata effettuata dall'utente registrato. Anche se l'Offerta viene fatta da terzi mediante l'utilizzo dell'Account.
È vietato fare offerte per i propri Lotti o per i Lotti di persone allo stesso collegate. Non è consentito che una persona collegata al venditore faccia offerte sui lotti di quest'ultimo. Tale procedura viene denominata "offerta con rialzo a trabocchetto", ed è contraria alle condizioni di utilizzo del sito.
È vietato contattare direttamente gli utilizzatori e/o terze parti per concludere un contratto di acquisto al di fuori del sito per Lotti messi in vendita sullo stesso.
Unicart Srl, ha il diritto di impedire temporaneamente o permanentemente in qualsiasi momento (prima, durante e dopo un'Asta online) le offerte sui Lotti.
Unicart Srl, a sua discrezione, ha il diritto di rimuovere un'Offerta in un'Asta online in corso se lo ritiene necessario (ad esempio in caso di possibile abuso o frode e in caso di ovvio errore da parte dell'offerente). In caso di eliminazione di un Lotto, anche tutte le offerte verranno rimosse
Non è consentito proporre ai venditori di concludere un accordo fuori dal sito web
2- Acquisto
L'utente-Acquirente e l'utente-Venditore di un bene cd lotto stipulano un Contratto di acquisto. Se l'Offerta fatta sarà la più alta alla fine dell'Asta Online, lo stesso sarà considerato l'Acquirente e l'utente stipulerà automaticamente un Contratto di acquisto con il l'utente-Venditore del Lotto. Tuttavia, nel caso in cui il Venditore abbia impostato un Prezzo di Riserva e l'Offerta sia inferiore al prezzo di riserva, non ci sarà alcun Contratto di acquisto. I Termini di Utilizzo si riferiscono ai doveri dell'utente per quanto riguarda il Contratto di acquisto.
Per l'utilizzo del Servizio sarà richiesta una commissione. La Commissione a carico dell'Utente-Acquirente è pari al 19% del Prezzo di acquisto (IVA inclusa). Tale importo verrà sommato al Prezzo di acquisto.
Saranno a carico dell'Utente-acquirente anche le spese di trasporto ed eventuali costi aggiuntivi di importazione (ad esempio, IVA, dazi di importazione). L'utente-acquirente comprende ed accetta che è una propria responsabilità controllare eventuali norme specifiche o restrizioni applicabili all'importazione di un oggetto nel tuo paese.
3 - Esportazione
Vi è richiesto di controllare che il tuo paese consenta di importare il materiale acquistato. Per l'esportazione fuori dall'Italia di oggetti acquistati è necessaria la licenza di esportazione rilasciata dai Beni Culturali, che l'acquirente è tenuto a procurarsi personalmente, Unicart srl non risponde per quanto riguarda tali permessi, né può garantire il rilascio dei medesimi. Unicart srl su richiesta dell'acquirente, può provvedere chiedendo al venditore di programmare le pratiche relative alla concessione delle licenze di esportazione, i relativi costi sono a carico dell'acquirente.
4 - Pagamento
Tutte le offerte fatte dall'utente-acquirente sono vincolanti. l'Utente-acquirente che si è aggiudicato un Lotto dovrà provvedere al pagamento dello stesso e dovrà seguire le seguenti regole: 1- Dopo l'aggiudicazione del Lotto, l'Utente-acquirente è tenuto a pagare entro quattro (4) giorni il Prezzo di acquisto le spese di trasporto al Venditore e (ii) la Commissione a carico dell'Acquirente alla Unicart Srl. L'utente-Acquirente, comprende che tutti i costi (come ad esempio le spese bancarie), tasse (come ad esempio le imposte alla fonte), dazi e corrispettivi dovuti sono a suo carico. 2- l'Utente-acquirente non dovrà acquistare il Lotto nell'ambito di una falsa transazione che consente a te e/o a terzi di cedere il Prezzo di acquisto totale o parziale e di riciclare il denaro in questione.
5 - Consegna
L'utente-Venditore spedisce gli oggetti all'indirizzo associato all'Account dell'utente-acquirente, pertanto i dati dovranno sempre essere aggiornati. Il l'utente-Venditore provvederà a spedire il Lotto dopo che Unicart Srl avrà ricevuto il pagamento presso l'indirizzo indicato nella fase di registrazione dell'Account.
In caso di problemi con il lotto, l'Utente-acquirente dovrà comunicarlo entro tre (3) giorni dalla consegna. l'utente-Venditore comunicherà il codice di tracciamento della spedizione del lotto l'Utente-acquirente accetta che non verrà valutato il reclamo e il Venditore riceverà il suo pagamento in caso di mancata comunicazione entro questo periodo di tre (3) giorni.
In caso di problemi relativi alla spedizione, gli utenti dovranno cercare una soluzione direttamente tra le parti interessate.
La Unicart Srl ha il diritto di annullare la transazione nel caso in cui il Venditore non consegni il Lotto. Se il Venditore non consegna il Lotto in conformità con i suoi obblighi ai sensi dei Termini e condizioni per Venditori la Unicart Srl, avrà il diritto ad annullare la transazione dal proprio sistema. La cancellazione della transazione non equivale ad una dissoluzione del Contratto di acquisto.
nel caso l'acquirente sceglie un metodo di spedizione non menzionato dal venditore, oppure decide di ritirarlo personalmente decade ogni responsabilità del venditore dal momento che viene preso in mano dal trasportatore o corriere scelto dall'acquirente. e scioglie qualsiasi legame tra acquirente e venditore, le eventuali dispute successive al ritiro gestito autonomamente dall'acquirente, devono intercorrere direttamente tra venditore e acquirente. Unicart Srl viene manlevata da ogni onere, obbligo e responsabilità.
l'acquirente è obbligato a monitorare la spedizione in modo di farsi trovare a casa il momento della consegna, nel caso la spedizione rimanesse ferma in dogana per qualsiasi evenienza, superati 10 giorni, Unicart Srl proseguirà con il pagamento al venditore, e scioglie qualsiasi legame tra acquirente e venditore, per ulteriori problematiche riguardo l'acquisto l'acquirente deve contattare direttamente il venditore e continuare con lui.
6 - Mancato adempimento dei doveri nei confronti del Venditore
In caso di mancato rispetto da parte tua dei doveri derivanti dal Contratto di acquisto nei confronti del Venditore, risulterai inadempiente e il Venditore avrà diritto allo scioglimento del Contratto di acquisto. Potremmo inviarti un avviso di inadempimento e un avviso di dissoluzione per conto del Venditore, ma non abbiamo alcun obbligo al riguardo. In tale contesto, i tuoi obblighi includono la compensazione dei danni nei confronti del Venditore, senza che vengano pregiudicati eventuali altri diritti del Venditore.
7 - Mancato adempimento dei doveri nei confronti
In caso di mancato rispetto dei Termini di Utilizzo nei confronti di Unicart Srl, potrebbe decidere di annullare la transazione del Lotto in questione. Tale cancellazione non equivale ad una dissoluzione del Contratto di acquisto. Tuttavia, in caso di annullamento della transazione, Unicart S.r.l. potrebbe ritenere l'utente responsabile di eventuali danni e spese sostenute e/o derivate dal mancato rispetto dei termini di utilizzo. Ciò significa che l'utente-acquirente sarà tenuto a versare una penale a carico utente-venditore e di Unicart Srl pari al 19% del valore del bene oggetto dell'asta
8 - Diritto di recesso
I Consumatori hanno diritto a una garanzia legale sulla conformità dei Lotti. Inoltre, a seconda del luogo di residenza, potresti avere diritto ad annullare e restituire l'acquisto senza bisogno di giustificazione.
È possibile che l'applicazione del diritto di recesso europeo sia valida per il tuo Contratto di acquisto. I consumatori che risiedono in un paese all'interno dello Spazio Economico Europeo e acquistano un Lotto da un Venditore professionista hanno diritto a recedere dall'acquisto entro un periodo di 14 giorni ("tempo di ripensamento"), senza bisogno di giustificazione.
In caso di recesso dall'acquisto, dovrai restituire il Lotto al Venditore. In virtù del diritto di recesso, sarai tenuto a restituire il Lotto entro 14 giorni dalla notifica di recesso. Dovrai restituire il Lotto al Venditore con tutti gli accessori consegnati e, nei limiti del possibile, nello stato e nell'imballaggio originale. Sarai responsabile soltanto per ogni eventuale diminuzione del valore del Lotto derivante da una gestione che vada oltre quanto necessario per stabilire la natura, le caratteristiche e il funzionamento del Lotto stesso. Ti verranno rimborsati l'intero Prezzo di acquisto, incluse spese di spedizione, e la Commissione a carico dell'Acquirente. Tuttavia, ogni costo diretto per la restituzione del Lotto sarà a tuo carico.
È possibile che l'applicazione del diritto di recesso non sia valida per il tuo acquisto. Ti preghiamo di notare che alcuni prodotti e servizi sono esclusi dal diritto di recesso come ad esempio, ma non limitatamente a, oro, diamanti, lingotti e altri prodotti che hanno prezzi fluttuanti, si deteriorano rapidamente o hanno una limitata durata possibile di conservazione.

Registrazione

Al momento della registrazione ed alla creazione dell'Account dovranno essere fornite le seguenti informazioni:

- Il fruitore è l'unico responsabile, per qualsiasi attività relativa al proprio Account, Unicart Srl non avrà la possibilità di verificare chi è il reale utilizzatore del proprio Account e pertanto, non avrà alcuna responsabilità in merito all'utilizzo.
I presenti Termini e condizioni per Venditori delineano i tuoi diritti e doveri per quanto riguarda il Contratto di Vendita tra l'utente-Acquirenti dei Lotti messi in vendita.
Presentare Lotti all'asta
Dopo la registrazione nell'apposita area come Venditore, potranno essere messi in vendita i Lotti di tua proprietà all'asta. Assicurati di leggere attentamente quanto segue.
- I Lotti.
Unicart Srl deciderà quali Lotti sono idonei alla vendita sul nostro Sito online. Unicart Srl si riserva il diritto di rifiutare dei Lotti senza dover fornire spiegazioni.
-descrizione chiara e completa del Lotto.
Nel mettere un lotto all'asta bisognerà fornire informazioni chiare e complete riguardo il Lotto. Devono essere inclusi, a titolo esemplificativo ma non esaustivo, i seguenti materiali e informazioni:
1. Una descrizione del Lotto corretta, completa e accurata.
2. Informazioni riguardo le condizioni e la classificazione del Lotto, compresa l'eventuale inclusione o meno dell'oggetto nel regime del margine nel contesto della legislazione applicabile in materia di IVA.
3. Una o più fotografie chiare che rappresentano accuratamente lo stato attuale (compresi eventuali difetti o imperfezioni), caratteristiche e altri particolari del Lotto.
4. L'eventuale Prezzo di riserva (l'opzione per impostare un Prezzo di riserva dipenderà dal valore del Lotto).
5. Un'indicazione di eventuali spese di spedizione.
6. Ogni altra condizione relativa all'oggetto offerto all'asta.
- Garanzia per la vendita del Lotto.
I lotti proposti in vendita non devono, violare qualsiasi legge o regolamento, (ii) violare qualsiasi diritto di terzi, compresi i diritti derivanti da accordi e Diritti di Proprietà Intellettuale, (iii) agire in modo fraudolento in generale, o (iv) agire in modo illegale e/o fraudolento nei confronti di terzi o di Unicart Srl, Utente- venditore Garantisce inoltre che l'offerta all'asta e la vendita del Lotto costituisce una transazione onesta e autentica. In particolare, garantisce di non mettere all'asta il Lotto nell'ambito di una falsa transazione che possa essere ricondotto al riciclaggio il denaro.
- Ritiro di Lotti dall'asta prima dell'inizio dell'asta stessa.
I Lotti possono essere ritirati dall'asta fino a quando non vengono pubblicati sul Sito online e sono visibili agli altri Utenti. Trascorso tale termine, l'utente-venditore non potrà più modificare le condizioni associate all'offerta dell'oggetto all'asta, ma si considereranno accettate, come da comunicazione che avverrà per e-mail dall'Unicart S.r.l.
Lotti all'asta
Una volta accettato e messo all'asta, altri Utenti-acquirenti possono fare offerte sul Lotto. L'utente-venditore deve accetti le seguenti regole:
- L'Acquirente e il Venditore di un Lotto stipulano un Contratto di Vendita.
Alla fine dell'Asta Online, verrà stipulato tra utente-acquirente e utente-venditore un Contratto di Vendita con il migliore offerente (l'Acquirente) del Lotto. Questo non avverrà nel caso in cui sia stato impostato un Prezzo di riserva e l'Offerta più alta risulti inferiore al Prezzo di riserva.
-Rialzo a trabocchetto.
L'utente-venditore non è autorizzato a fare offerte per i propri Lotti o per i Lotti di persone ad esso collegate. Non è inoltre consentito che una persona collegata all'utente-venditore faccia offerte sui propri Lotti. Tale pratica viene denominata "offerta con rialzo a trabocchetto".
- I Lotti proposti sul Sito online Unicart Srl verranno offerti esclusivamente nel sito
I Lotti proposti nel sito online di Unicart SRL non potranno essere proposti siti web, comprese le piattaforme online, e dai siti web di vendita di proprietà dell'Utente-venditore o di proprietà di terzi, se tali Lotti sono inseriti in una delle aste online di Unicart Srl.
Consegna o ritiro dei Lotti
A seguito della vendita di un Lotto, l'utente-Acquirente dovrà pagare il Prezzo di acquisto, eventuali spese di trasporto e la Commissione a carico dello stesso. La Unicart Srl informerà l'utente-venditore non appena l'Acquirente avrà effettuato il pagamento, così da consentire all'utente-venditore di spedire il Lotto all'Acquirente.
Le caratteristiche, colori, fattezze, ecc di ogni lotto vengono descritte dalle e immagini e caratteristiche fornite dall'utente-venditore. Nel caso l'oggetto fosse diverso da quanto possa essere percepito attraverso le informazioni e immagini fornite dall"utente-venditore e caricate su unicartauctions.com o altra piattaforma astistica gestita da Unicart Srl, l'utente-venditore ha l'onere del pagamento del ritiro dell'oggetto non conforme e libera Unicart Srl sin da subito da ogni responsabilità. Inoltre, nel caso di disputa tra venditore-acquirente, entrambi si rimetteranno alla decisione imparziale di Unicart Srl che stabilirà la conformità dell'oggetto alla pagina web che lo ha rappresentato.
- Il Lotto deve essere spedito entro quattro (4) giorni lavorativi dal pagamento.
Il lotto dovrà essere imballare con cura ed inviato entro quattro (4) giorni lavorativi dalla ricezione della conferma del pagamento da parte della Unicart Srl. L'utente-venditore è pienamente responsabile per la spedizione del Lotto all'Acquirente.
- I Lotti dovranno essere spediti con codice di tracciamento.
I rischi delle spedizioni per eventuali danni e/o perdita dei Lotti durante il trasporto sarà a carico dell'Utente-venditore.
- I Lotti devono essere spediti dall'indirizzo indicato nell'Account
L'utente -venditore è tenuto a spedire i lotti dall'indirizzo indicato nel proprio Account, indicato nella fase di registrazione. In caso di spedizione del Lotto da un indirizzo diverso, i costi aggiuntivi saranno a carico dell'utente-venditore.
L'utente-venditore dovrà contattare l'utente- Acquirente in caso di problemi con la spedizione. In caso di smarrimento e/o danneggiamento del Lotto durante la spedizione, bisognerà raggiungere una soluzione direttamente con l'utente-Acquirente.
Pagamento dei Lotti
il Prezzo di acquisto verrà versato all'utente venditore (al netto della Commissione a carico del Venditore) dopo che l'Acquirente avrà provveduto al pagamento del Prezzo di acquisto, delle eventuali spese di trasporto e della Commissione a carico dell'utente- Acquirente, e (l'utente-venditore avrà spedito il Lotto
- trattenere il pagamento. Unicart Srl avrà diritto di sospendere il pagamento nel caso in cui l'utente-Acquirente abbia notificato una controversia dovuta, ad esempio, a presunti danni o non conformità del Lotto.
- diritto di annullare una transazione in caso di mancato pagamento da parte dell'utente Acquirente.
Se l'utente-Acquirente non effettuerà il pagamento in conformità con gli obblighi dell'utente-venditore, Unicart Srl provvederà a sollecitare il pagamento. Se, l'utente- Acquirente non provvederà al pagamento, l'utente-venditore accetti e riconosca che Unicart Srl potrà annullare la transazione nel nostro sistema. La cancellazione della transazione non equivale ad una dissoluzione del Contratto di Vendita. Una volta annullata la transazione, l'utente-venditore potrà decidere di presentare nuovamente il Lotto all'asta o contattare direttamente l'utente- Acquirente per far valere i propri diritti derivanti dal Contratto di Vendita.
- Il diritto di non corrisponderti il pagamento.
In caso di mancato rispetto delle nostre Termini e condizioni di Utilizzo Unicart Srl, si riserva il diritto di non corrispondere il pagamento per il Lotto in questione. In questo caso l'utente-venditore accetta e riconosce che rinuncerà a qualsiasi rivendicazione che potresti avere nei confronti di Unicart Srl per i suddetti pagamenti.
Mancato adempimento dei doveri nei confronti dell'Acquirente
In caso di mancato rispetto dell'utente-venditore dei doveri derivanti dal Contratto di Vendita nei confronti dell'utente-Acquirente, l'utente-venditore sarà considerato inadempiente e l'utente-Acquirente avrà diritto allo scioglimento del Contratto di Vendita.
L'utente-venditore dovrà rimborsare all'utente- Acquirente del Prezzo di acquisto se già ricevuto da parte dello stesso. Unicart Srl non sarà responsabile del rimborso.

B) Unicart Srl is not a party to the Contract of Sale. The user-seller is fully responsible for shipping the Lot to the Buyer. - The Lots must be sent with a tracking code.
