The object of purchase shall only be delivered to the customer by Karl & Faber after receipt of the complete purchase price including shipping costs. The delivery period shall be five working days. The delivery period shall begin upon conclusion of the contract and the complete payment of the purchase price.

Alternatively, the customer may collect the object of purchase from the business premises of Karl & Faber after full payment of the purchase price and prior agreement of a collection date. Karl & Faber may refuse a collection if it is to take place later than 14 days after receipt of full payment of the purchase price.

If the customer is a consumer, Karl & Faber shall bear the transport risk; if the customer is an entrepreneur or merchant, the customer shall bear the transport risk.

The purchase price and the shipping costs are to be paid within two weeks of receipt of the invoice by Karl & Faber at the latest.

The customer is not entitled to offset against purchase price claims of Karl & Faber or to assert rights of retention unless counterclaims of the customer have been legally established or are undisputed or concern notices of defects or counterclaims from the same purchase contract. If the customer is an entrepreneur or merchant, he waives his rights under § 273 and § 320 BGB.

Premium: PRICES AND SHIPPING COSTS

All price quotations and purchase price offers within the scope of the online only auctions are to be understood as exclusive of any shipping costs incurred, as well as a surcharge and the statutory value added tax. The amount of the premium and the type of taxation are regulated below.

Shipping fees for Germany & EU countries via FEDEX:
Karl & Faber generally ships all works unframed. Smaller works of art with an insurance value up to € 25,000 can be shipped within Germany and the EU at the rates listed below. For shipment outside of the EU and for larger works, please contact our shipping department at [email protected]. If necessary, we will prepare the export documents for you for an additional fee of € 25.

Paintings/works on paper/prints
- pictures/sheet up to 30 x 30 cm: shipping fees € 30*.
- pictures/sheet up to 60 x 50 cm: shipping fees € 40*.
- pictures/sheet up to 100 x 80 cm: shipping fees € 60*-80*
- pictures/sheet over 100 x 80 cm: Shipping fees from € 100*.

Sculptures
- up to 3 kg: shipping fees € 30*
- up to 6 kg: shipping fees € 40*
- up to 10 kg: shipping fees € 60*
- more than 10 kg: shipping fees from € 80*
*All prices quoted are gross prices.

The insurance up to a value of € 25.000 is included in these fees.


When purchasing within the framework of an online only auction, the buyer must pay a premium in addition to the purchase price; the following differentiation is made:

a) For regularly-taxed works of art (marked with "R"), the buyer shall be charged per individual object a premium of: 28% on a purchase price up to and including € 100,000.00, 23% on a purchase price over € 100,000.00 up to and including € 500,000.00 for the amount in excess, 18% on a purchase price over € 500,000.00 for the amount in excess. Statutory turnover tax at a rate (at present) of 19 % shall be added to the hammer price, the premium and any further costs which may be charged, and shall be separately shown on the invoice.

b) If differential tax is applied pursuant to § 25 a of the Value Added Tax Act (UStG), the premium payable is increased by (at present) 19% value added tax, which is charged on the premium and on any further costs which may be charged and is not indicated separately. The applicable breakdown specified in 4 a) above shall then be 33.32%, 27.37% and 21.42%. An "N" behind the catalogue number indicates that the work of art originates from a country outside of the EU. For such objects, the advanced import tax will be charged at a rate of 7 % of the hammer price in addition to the premium.

Fees & Taxes: All price quotations and purchase price offers within the scope of the online only auctions are to be understood as exclusive of any shipping costs incurred, as well as a surcharge and the statutory value added tax.

Any customs duties and charges or other costs incurred in connection with the export and import of the object of purchase shall be borne by the purchaser. It is the obligation of the buyer to inform himself about import and export restrictions.
